1. General

Diaper-Heroes is a trademark of the DRYBOX IS

These terms and conditions apply to all distance selling (online or by phone) to end-users. DRYBOX IS reserves the right to modify its general conditions at any time. Nevertheless, contracts concluded prior to the amendment will remain subject to the terms and conditions applicable at the time of the conclusion of the sale.

The client receives the general terms and conditions with the confirmation of his order, in a format that it will be able to save or print. The convention can be concluded in Dutch, French, English or German, at the choice of the customer. Any exchange subsequent information with the customer will be in the language chosen by the client. The latter will not be able to take advantage of his lack of knowledge of the language chosen to seek the non-application of one or several clauses of these general conditions.

2. Conclusion of the distance selling

To book and/or order a product online, the customer must add it to his cart and then he must choose the method of delivery (cf art. 5) ; it complete his personal data and confirms the method of payment (cf art. 3).

The booking/order is final when you click "payment" and the performance payment (unless special conditions authorize payment to delivery). To book and/or order a product by phone, the customer has to just call at (+32) 0471 917 010 and it will be guided throughout the buying process.

The catalogue of the products presented on the site area-does not constitute an offer within the meaning of article of the civil code. It is not enough, therefore, not to book and/or ordering a product via the website or by phone to ensure that the contract of sale is formed.

The sale will be concluded by the receipt of the email confirmation sent to the client and incorporating all of his personal data, billing address and delivery, and order details.

DRYBOX IS reserves the right to refuse to execute a command when it appears to him that the buyer is a minor or a major incapable or that the buyer did in fact intend to resell the(s) product(s) ordered(s). It's the same when a manifest error is introduced in the product description or the indication of its price, in spite of all the care taken by DRYBOX to provide the appropriate information ; in this case, the customer will be informed and he will be invited, on the basis of the information concerning corrective provided, to renew or to confirm his order.

In the case of force majeure, DRYBOX IS entitled to suspend the performance of its obligations related to the conclusion of a sale for the duration of the said event of force majeure, without liability for non-performance or improper performance of the contract cannot be sought or committed.

3. Price and payment

3.1 Price

All our prices are VAT, Recupel and other taxes (except customs duties may be applicable).

In the case of sale within the community, the prices indicated may be modified either upward or downward by the application of the legal provisions on the VAT, without the client community can claim.

3.2 Payment

Unless otherwise agreed, any booking/order is confirmed by the receipt of the full amount of the order to pay. Payment in full is due within seven (7) days of the booking/order.

The accepted payment methods are specified at the time of the choice of the payment method on the site Find all. The customer is entirely free to choose the mode of payment that suits you the best.

Any booking/order which is not paid within the time period cited in the first paragraph will be automatically cancelled, unless otherwise agreed or special conditions granted to the customer. In the event of a booking/order is specified with payment of a deposit, DRYBOX Salt reserves the right to retain the said deposit as liquidated damages, in case of a faulty performance of any of its obligations in the head of the client.

3.3 Invoice

DRYBOX may issue an invoice for the VAT. In this case, the customer must make the request at the time of making the booking or placing the order ; he must also provide his / her VAT number. The customer shall bear any administrative costs related thereto.

4. Transfer and reservation of title

Without prejudice to the provisions of article 3.2 above, any product sold and delivered remain the property of DRYBOX IS until full payment of the price on the invoice. Notwithstanding the reservation of title is stipulated, the risk of loss and damage to the product sold are transferred to the customer upon taking possession of the product.

5. Delivery

DRYBOX IS will make every effort to ensure that the ordered product is delivered on time and agreed price. The delivery times are indicative only. A delay in delivery can in no case give the right to damages nor to the cancellation of the order.

The customer is obliged to check the contents and condition of the package upon its receipt. Any damage or defect apparent on delivery must be clearly indicated on the packing slip or receiving terminal of the deliverer.

Any damage or fault apparent non-declared as indicated in the previous paragraph will not open right to any compensation from DRYBOX that will not be held responsible.

Any damage or defect not apparent on receipt of the delivery shall be the subject of a written complaint (letter, fax, email) within 48 hours of receipt. It's the same for any product missing.

6. Cancellation of order

In case of cancellation of the order, DRYBOX IS reserves the right to retain an amount of up to ten (10) euros in respect of administrative costs relating thereto. In addition, will be retained for all charges related to the payment method chosen, in particular for orders paid by credit card or by Paypal an amount equivalent to 10% of the total. Cancellation of any booking/order that is not invoiced and not paid shall not be subject to any fees.

7. Right of withdrawal

Any qualified customer (consumer) by the belgian law recognised a right of withdrawal of fourteen (14) days from the day following the delivery. The(s) product(s) doi(ven)t be returned(s) in their original condition, complete with all accessories and documentation, and in its(their) original packaging to the following address :

Delivery charges and return costs will be the responsibility of the customer. The(s) returned products will be subject to a refund to the customer, subject to the conditions mentioned in paragraph 2 above. The right of withdrawal is not open to the products created, personalized or customized specifically for a client.

8. Responsibility

The responsibility of a DRYBOX IS not can in no case be engaged in case of delay of delivery due to the failure of one of its suppliers, particularly in the case of out of stock. The photos and other illustrations of the products have no contractual value, so that the differences are not substantial between the photograph(s) (and/or illustration(s)) product presentation on the site and the product(s) ordered(s) will not be able to engage the responsibility of DRYBOX IS

DRYBOX IS does not give any guarantee as to the delivery of the products by the company in charge of the delivery. The responsibility of DRYBOX IS may not be held liable in case the delivery is delayed due to the failure of the company responsible for the delivery or in the event of loss or damage caused to the product during transportation.

9. Severability of clauses

The nullity of one or several clauses of these general conditions does not prevail in any way the invalidity of the other clauses which shall remain fully applicable.

10. Applicable law and jurisdiction

These general terms and conditions and any booking, order and distance selling through the website are governed by French law. Any dispute relating to the execution of a booking order or distance sales governed by these general terms and conditions falls within the competence of the French courts.
